Hello, My name is Chuck Powell.  I am a 5th generation Lee County, Fort Myers, FL native.  My family still live here.  My family has been involved in Fort Myers history and life for a very long time since the 1800's when William F. Powell was on the first incorporation committee for the City of Fort Myers.  

 

Recently we were notified by local media, that the City of Fort Myers government and Mainsail Development Company were building a 91 million dollar project specifically a hotel on the property that my Grand Aunt Annie Powell Dean and my Grand Uncle John Morgan Dean transferred to the City of Fort Myers (ALL PEOPLE) in 1936 along with several other property owners in the same area.  Their Deed for the property naming the City of Fort Myers as Owner, also specifically stated that the property was forever to be used for a Park, and access to the Yacht Basin there on the water.  It could not be ever sold or used for commercial business ever.  The intent of the language of the Deed was very clear and specific.  These owners did not want commercialization to occur along the Caloosahatchee River in Downtown Fort Myers. Rather they wanted all citizens of Fort Myers to have access to and enjoy a park setting and clear access to and from the facilities of the Yacht Basin.

 

The City of Fort Myers has known about these deeds for years.  The Ex Mayor of the City, James Humphrey is now their external attorney hired by the Council to try to facilitate this land grab.  We have a Facebook Group created and encourage you to join, and participate.

For brevity purposes, we as a family feel that the various deeds need to be honored and adhered to pursuant to the original terms of the transfer.  The property of the Deans is estimated to be valued at 19 million dollars by the CIty.  We as a family do not want money, or the land.  We simply want the property deeds to be honored as any other legal document should be.   Simply put, this is defying the deed and grabbing the land for commercial enterprise for a project that we feel is destined for failure because of the existing Sheraton Hotel that was built on the same street years back that was also sold as a pipe dream.  The developer and City promises fell through and it went bankrupt losing all of the taxpayers money in the process.  This has to stop.  This current project has the City spending 24 million Dollars of taxpayers money once again to benefit the greedy few in power.

 

Help us by enlisting the legal services of the National Group of Lawyers who represented the Miami-Dade County vs Crandon Park (Mathes Family) in which was a point on similar case.  Miami Dade lost the battle.  The group is Carlton Fields P.A. Miami Branch.  We can have them start by hitting the ground running.  Why?

Because as of Friday May 18th, 2018, the City of Fort Myers has filed suit against the descendants of the properties in question.  The City has not even talked to us or corresponded once with us.  They truly are pushing this down the throats and pockets of all citizens without justification and/or concern for legal, ethical, or moral issues.

 

The initial retainer for us to procure Carlton Fields is $5000.00.  We would like to do this and raise additional funds as more properties are in danger exactly like this one if this is pushed through the courts.  Please help us defend our City resources and protect our lands, and just as importantly Taxpayer money.
